What is the procedure for filing a FOIA request?

You can request a copy of any information contained in your claim folder under the Freedom of Information Act/Privacy Act (FOIA/PA), which provides a process by which every person may request access to federal agency records or information. There are no special forms required to submit a request; however, VA requires that your FOIA request:

-Must be in writing and signed by the person submitting the request. The following must also be adhered to:

1.Reasonably describe the records so that it may be located with a reasonable amount of effort.
2. State your willingness to pay applicable fees or provide a justification to support a fee waiver.
3. Include a daytime telephone number in case we need to contact you.

Requestors should mail FOIA/PA requests to the intake center location, below. You may submit your request using VA Form 21-4138, Statement in Support of Claim. You can obtain this form at:

You may receive a quicker response if you identify specific information in your folder that you want, such as a rating decision or a notification letter.

If you seek compensation benefits records contained within a VA claims folder, or military service medical records in VA's possession, your request will be fulfilled by the VA Records Management Center (RMC) as part of the Centralized Freedom of Information Act/Privacy Act (FOIA/PA) initiative.

Please keep in mind that all FOIA requests are completed on a first come, first serve basis. The law requires a response within 20 working days of the date that the request is received by the custodian of the record. Within that time, the custodian of the record is required to at least advise the requester VA has received their request, and whether VA has any information responsive to the request. If feasible, the requested information will also be released within 20 working days. If there is a backlog of pending requests, it will take longer to provide a final response.
